The following General Terms and Conditions shall apply for all contracts which a consumer (hereinafter: “Customer”) concludes with Engelbert Strauss ApS (hereinafter: “Engelbert Strauss”) regarding the goods and/or services presented in the internet shop. A “consumer” is any individual completing a legal transaction for a purpose that is not predominantly associated either with his/her commercial or independent professional activity. Deviating conditions are not recognised by Engelbert Strauss unless the company explicitly agrees to their validity.
By clicking on the "Ready To Order" button, the Customer hereby submits a binding order which represents a contractual offer. Before sending his order, the Customer has the opportunity to check the information which has been entered and change it if necessary using the “Final Check” section. After sending the order, an e-mail shall be sent to the Customer confirming the receipt of the order and the details. This order confirmation does not represent acceptance in terms of purchasing law; it serves only to inform the Customer that their order has been received by Engelbert Strauss. A conclusion of contract shall only arise when Engelbert Strauss explicitly accepts this offer or the goods are sent to the Customer. Conclusion of the contract and processing shall take place in Danish. Engelbert strauss reserves the right not to perform the ordered service and reimburse the purchase price to the Customer if the goods are out of stock or are temporarily out of stock, despite the prior conclusion of a corresponding purchase contract.
Delivery of the products shall take place by payment in advance unless a different arrangement has been made. Engelbert Strauss shall offer free delivery for goods with a value of kr 998.75 including VAT (kr 799 excluding VAT). If the Customer’s order value is less than this, the shipping costs for the Customer shall amount to kr 61.25 including VAT (kr 49 excluding VAT). In general, Engelbert Strauss shall pay the packaging costs. Orders with promotional labelling shall be produced by engelbert against payment in advance.
The delivery period for the goods shall depend on the payment method selected. In the case of advance payment, the Customer shall generally receive their delivery in 3 to 5 working days (Monday to Friday, excluding Saturdays) after receipt of payment; in the case of payment on invoice, the Customer shall generally receive their delivery in 3 to 5 working days (Monday to Friday, excluding Saturdays) after receipt of the order by the company. If the goods are embroidered or printed, or altered in any other way according to the Customer’s instructions, a delivery date shall be agreed for the individual case.
We do not deliver to Greenland or the Faroe Islands.
All the prices stated to the consumer exclude statutory VAT. The prices applicable in the web shop on the day of the order shall apply.
If the goods are defective, the statutory provisions on defect liability shall apply with the following limitations; Engelbert Strauss shall not be liable for damages due to incomplete, delayed or non-service if this was caused due to a fire, strike, lock-out,
force majeure or other circumstances lying outside of Engelbert Strauss’ control. The same shall apply if the incomplete, delayed or non-service was due to one of the aforementioned circumstances occurring to a supplier of the company. In the event of non-delivery or a delivery delay on the part of pre-suppliers, Engelbert Strauss shall be entitled to withdraw, with respect to the Customer, if the goods are out of stock or are temporarily out of stock despite the prior conclusion of a corresponding purchase contract. Engelbert Strauss undertakes to immediately inform the Customer of non-availability and to immediately reimburse payments made by the Customer. In the case of damages caused by Engelbert Strauss, liability for simple negligence shall be excluded. This shall not apply to injury to life, body or health, the breach of a cardinal obligation (i.e. such obligations whose fulfilment primarily allows the proper execution of the contract and on the fulfilment of which the Customer regularly relies and may rely), to guarantees or to claims concerning the Danish Product Liability Act. This shall also apply to the actions of legal agents, employees or vicarious agents of Engelbert Strauss. Liability, in the event of a negligent breach of material contractual obligations, is limited to direct damages. This does not apply to personal injury of life, body or health. The mandatory statutory claims by the Customer shall not be affected by the preceding liability limitations.
If an agreement is not reached, the Customer may consult the Swedish Consumer Complaints Council.

The Customer has the option of the following payment methods: Credit card, Dankort, Paypal, advance payment or invoice with a payment target of 30 days. Engelbert Strauss reserves the right to perform a credit check for these payment types. By submitting your order, you agree that invoices may be sent electronically (e.g., by e-mail) or by mail, at our option. The Customer is in arrears if he does not pay engelbert strauss within 30 days of receipt of the invoice or an equivalent payment schedule at the latest. In the event of default in payment, default interest in terms of § 5 of the Danish Interest Act shall be charged. The Customer is advised that reminder fees of DKK 100 shall be charged for reminders as well as a compensation fee of DKK 310 according to the provisions of the Danish Interest Act.

You have the right to cancel this contract within fourteen days without giving reasons. The cancellation notice period amounts to fourteen days from the day on which you take possession of the last item. To exercise your right to cancel, you must inform us

by means of a clear statement (e.g. a letter sent by post, fax or email etc.) regarding your decision to revoke this contract. You may use the attached cancellation form for this. The use of the form is not necessary for an effective cancellation, however. To observe the cancellation period, it is sufficient for you to send the notification of the exercising of the right of withdrawal prior to the expiration of the cancellation period.
If you cancel this contract, you must return the received goods to us. We shall refund you all payments that we have received from you, including delivery costs (with the exception of the additional costs arising from choosing a type of delivery other than the cheapest standard delivery offered by us), immediately and no later than within fourteen days of the date on which we received the notice of cancellation for this contract. For this repayment, we shall use the same payment method that you used for the original transaction, unless we have explicitly made other arrangements with you. Under no circumstances will you be charged any bank charges for this repayment. We may refuse repayment until the goods have been returned to us. You must send back or transfer the goods to us immediately and, in all cases, no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods prior to expiry of the fourteen day period. We shall bear the costs of returning the goods. You shall pay for any diminished value of the goods, only if this diminished value is attributable to your handling of the goods in any way other than what is necessary to ascertain the quality, nature and function of the goods.
